Your participation in any exercise program (“EXOS Activities") conducted in locations such as your home (the “Center”), as provided by EXOS, is voluntary. You understand that there may be health risks associated with activities requiring physical exertion, including but not limited to fainting, nausea, musculoskeletal injury, sprains, heart attack, stroke, or death (“Issues”). You assume full responsibility for any and all injuries or damages occurring from your participation. If you experience Issues while participating, you will discontinue the activity and consult your physician. You certify that you are capable of performing physical exercise and acknowledge the dangers involved. As such, you waive any and all claims you may have, on behalf of yourself, your heirs, and/or assigns, against EXOS and its respective subsidiaries, affiliates, directors, officers, employees, agents, and all others ("Releasees") from all liability for injury, death, or loss suffered by you while participating. You hereby fully and forever release the Releasees from any and all claims, demands, damages, and/or causes of action, present or future, whether known or unknown or anticipated or unanticipated, resulting from or arising out of the EXOS Activities, including but not limited to any claim for negligence.
